Announcement - EGG Con is Seeking Donations to Fund the E. Gary Gygax Memorial Scholarship

What is the E. Gary Gygax Memorial Scholarship, you ask? Erik and Heidi Gygax Garland recently set up this new annual scholarship award through the Badger High School Scholarship Committee, with the first scholarship to be awarded to a high school junior or senior in May 2025. To be eligible, the student must be in good standing and desire to pursue higher education leading to a career as an author and/or game designer. The applicants will submit a short story in the genre of fantasy or science fiction with the awardee being chosen by a committee of three (or more) published authors. 

All proceeds, less payment processing fees (usually about 3%-5%) realized from the auction will go to the scholarship fund. Erik Garland

GoFundMe - Ernie "The Barbarian" Gygax Needs Aid

We have a friend in need...can you help?

Ernie “The Barbarian” Gygax has been in many D&D battles in his life being the eldest son of the co-creator of the D&D game. Now, he is in a fight for his very life – in fact, he has been in-and-out of hospitals and in-and-out of critical condition over the last few months. He even died for several minutes this past week, but was able to be revived. I won't go into many details, but he has a heart defect that results in not enough blood being pumped through his body and, more importantly, not delivered to vital organs...like the kidney. That means, in addition to heart issues, he is also needing dialysis to help the kidney to do it's job. Like any barbarian though, he keeps fighting – winning each individual battle so far, but he's getting wary and frustrated by his body's growing weaknesses.

The initial reason for this fundraising campaign is to help Ernie and Donna with the medical bills that are already mounting AND to help cover some of the hotel expenses for Donna (Ernie's significant other, soulmate, and Health Care POA), while she stays by Ernie's side every day at the hospital helping him through this and making some VERY difficult medical decisions along the way. Going forward with the time he has left, even accounting for the best possible situation, Ernie will need to follow strict guidelines and be severely limited in his activities...but HOPES that he and Donna can once again offer a place at their home in Lake Geneva for gamers to stop by and roll some dice.

Did you know that:

  • The cost for an Air Ambulance (Life Flight) is between $12,000 - $25,000 (used twice),
  • Average Ambulance transport in Wisconsin is $1,200 (used twice)
  • Average for 1 Day in ICU/Critical Care: Numbers vary widely depending on how sick you are, but an average of $8,000-10,000 is typical – more the first few days and a little less beyond that (More than 10 WEEKS in 4 different hospitals.),

Today Ernie is fighting for his life...tomorrow they'll both be fighting to dig out from the pile of bills – even with insurance picking up a good portion of that tab. He has used all of those expensive services multiple times during his struggle over the last few months plus many doctor visits for months before that as he began feeling the affects of his body's weakening. Between the various ambulance services, hospitals, numerous doctors, procedures, medications and services provided, they'll be getting bills for many months.

E. Gary Gygax Probate Case Update

Here's the text:

10:01 a.m., Court in session.  Attorney Joseph A Kromholz in court for Lucion Gygax.  Attorney Jennifer M Gorn in court for Lucion Gygax.  Attorney Theodore Nathan Johnson in court for Gail Carpenter Gygax.  Personal Representative Steven A. Koch in court. 

Parties have reached an agreement.  

Attorney Johnson will provide information to Attorney Koch regarding largest item sold.  Other issues will be held in abeyance.  Mediation date has been scheduled.

Future court dates remain as scheduled.

Dave Johnson Games KNOWS Alarms & Journeys is the Successor to Gygax Magazine

There's something about Dave Johnson that implies douchebaggery (in my humble opinion - your opinion may vary). Maybe it's the game Dave has turned the release of Star Frontiers: New Genesis into. Note, I'm not talking about the actual ruleset, which likely only exists in a tangible format in the rocky crags of Dave's mind. I'm talking about the "release game" - free copies of SFNG at TSR Con! No Dave Johnson at TSR Con and no copies of SFNG at TSR Con (apparently due to Dave getting hit with Covid, and then recording the announcement of the delayed release of SFNG at a restaurant while still suffering from the effects of Covid), announcing the shipping of SFNG the end of last week, followed by the announcement of limited playtesting and a very limited number of playtest copies available. (so, copies apparently AREN"T shipping). Good luck getting into the playtest, Dave's blocked about half the community in the official Star Frontiers: New Genesis Facebook Group ;)

If you think that timeline is a bit bizarre, read the above pic at the top of this post. Notice the reference to Gygax Magazine, including using the magazine's logo. Did you happen to see Dave couldn't be bothered to do a simple google search to determine if it had been "5 or 6 issues"? What kind of lazy fuckery is that? You claim to have "taken the mantle" of Gygax Magazine, and you have no clue how many issues of Gygax Magazine was published. Dave, as a simple FYI, it lasted six issues. Always looking to have others do your work for you I see ;)

News - Ken "Turbo" Trbovitch Resigns as President of Servotronics


The "Turbo" saga appears to have come to a conclusion, with Ken "Turbo" Trbovitch resigning as President of Servotronics.

The lawsuit referred to below named Gary Con and Luke Gygax within its pages.

ELMA, N.Y., Dec. 27, 2021 /PRNewswire/ -- Servotronics, Inc. (NYSE American - SVT) announced that Kenneth D. Trbovich has resigned as Chief Executive Officer and President and was removed as Chairman of the Board, after a nearly six-month-long internal investigation identified grounds for his termination.

While the Board of Directors conducts a search for a permanent replacement, the responsibilities of the CEO and President will continue to be carried out by other personnel, led by Chief Operating Officer James C. Takacs.

The Board's non-employee directors stated:  "Our highly skilled workforce and experienced management team have ensured that Servotronics continues to deliver on its reputation for meeting and exceeding government, defense, commercial, consumer and other customers' high standards for quality and reliability, which has been built over more than six decades. This team has delivered sequential sales growth in the second and third quarters of this year, while continuing to invest in people, product development, and production capabilities that are designed to position Servotronics for the future. We look forward to providing Jim Takacs and his team with the resources they need to continue executing, while the Board conducts an active search for a new CEO."

Today's announcement follows a previously disclosed internal investigation, authorized by the Board on June 8 when Mr. Trbovich was placed on administrative leave, one day after a then-employee filed a civil complaint making allegations regarding the executive's conduct. The investigation was undertaken by independent, outside counsel.

On Dec. 1, Mr. Trbovich was informed that grounds for termination were identified during the investigation and a Dec. 22 meeting was scheduled for the Board to hear from the executive and consider the matter. On Dec. 21, Mr. Trbovich resigned as CEO and President. At its Dec. 22 meeting, the Board accepted his resignation, removed him as Chairman, and based on the findings of the investigation determined that he committed willful malfeasance that would have justified termination. The Company has not disclosed other findings of the investigation, as they relate to personnel matters.

While the former executive remains a director, the Company does not intend to renominate him for election to the Board at the 2022 annual meeting of shareholders.

A Breakdown of the Relevant Parts of the Turbo/Servotronics Lawsuit and the Mentions of Luke Gygax and Gary Con



I've been asked by multiple people over the last few days as to when I was going to address the Servotronics / Kenneth Trbovich lawsuit. Well, here we go...

I became aware of the "Turbo" lawsuit Saturday morning when a friend messaged me the PDF telling me I'd be interested. I started to read it, wondering why it would be of any concern to me when I started seeing "Gary Con", "Gygax" and "Luke Gygax" get mentioned in the filing - multiple times. A lot.

It then dawned on me that Kenneth Trbovich was "Turbo" from Gary Con. I now realized I had 104 pages of a dumpster fire. Really. You can snag your own copy of the Trbo Lawsuit at this link. I dare you to call it anything but a dumpster fire.

The allegations detailed within are beyond belief and fall along the lines of "throw everything into your lawsuit and see what sticks". More, literally, is more. 

It reads like the script to a Porky's reimagining. If only 10% is accurate, Turbo is a pretty shitty person. The thing is, there are exact dates given. Which likely means the plaintiff was documenting events as they happened. Leaving out the personal drama, it shows a dysfunctional business environment.

There are, however, some parts that are relevant. One allegation states that: "Trbovich’s compensation began to balloon, particularly after Gygax was appointed Chair of the Compensation Committee." (page 47) Turbo's compensation jumped 70% from 2019 to 2020Luke was appointed Chair of the Company's Independent Directors Committee and is also a member of the Company's Audit Committee. As Turbo and Luke are/were friends, and Turbo participated as either staff or as a volunteer at Gary Con for a number of years, this part doesn't look particularly great for Luke.

Yep, Luke was paid $85k a year as an Independent Director in 2020 by Servotronics.


Nor does Luke and Turbo going on a trip to Eastern Europe together, which kinda strains the idea of an "independent director must be completely independent and they cannot receive any compensation of any kind outside of Board stipends and reimbursement for legitimate Company expenses (such as travel to Board meetings)."(page 50)

Gary Con gets its first mention with: "Gary Con was (and is) a gaming convention owned and operated by Gygax, the “independent” director and the Chair of the Compensation Committee and Audit Committee Member." (page 52) It appears Servotronics employees were sent to the con on company time and compensation.

Then we apparently have a book written by Turbo and Luke: "In March 2019, Trbovich revealed to Pirrone that he (Trbovich) had co-authored with “independent” director Gygax a book for Gary Con. Trbovich used his nickname “Turbo” as a pen name. Trbovich implied to Pirrone that he used his pen name in an effort to conceal his identity from the Board, shareholders, and anyone else with an interest in the Trbovich Companies." (page 53). The book/module in question is Knight Fall, and yes, Turbo is credited along with Luke and Chris Clark.

Pages 60-61 give us: "Trbovich mentioned, for the first time, that he knew his travel with Luke Gygax was brought into question by the Whistleblower Complaint, as well as his spending on Noura Ibrahim." and "Specifically, Pirrone reported his concerns of corporate waste, fraud, dereliction of fiduciary duties, as well as other unlawful and unethical conduct, including, without limitation: (1) Trbovich’s Company-funded all-expenses-paid trips to Prague and Gary Con with “independent” director Luke Gygax, the Chair of the Company’s Compensation Committee; (2) Trbovich’s use of Company funds to support Gygax’s personal business ventures that are not legitimately related to the Company or the Company’s business interests; (3) Pirrone’s suspicion that Trbovich is a silent part-owner of Iron Wind (Mike Noe’s company) and Monster Fight Cub (Gygax’s company); and (4) information about Trbovich’s use of Company funds for trips and plane tickets for Servotronics contractors with whom Trbovich had admitted having a sexual relationship, quid pro quo, including Noura Ibrahim.

Page 65: "On November 15, 2019, CFO Bencel approached Pirrone to discuss the Company-funded business trips to Gary Con, involving Gygax, Grayson, and Redd. Pirrone shared dates and photographs from social media. Pirrone also reported to CFO Bencel the cross- country “business trip” involving Grayson and the aforementioned Candace (“Candy”) Miller."

Page 72: "For example, on January 28, 2020, Pirrone reported to CFO Bencel that he had found a link to a “streamed game event” from Gary Con where Beast Grayson (who was present on the Company’s dime and, in fact, reimbursed for his travel and lodging), participated in a live stream “celebrity” game with Gygax. Pirrone reported this information and suggested that these events are required by law to be referenced in the independence questionnaires for the Board. A short while later, HR Director Zechman emailed Pirrone, out of nowhere, requesting verification and additional information about the paid leave Pirrone had taken back in 2017."

Pages 73-74: "Reminder that when Ken had Luke Gygax and Jason Bear appointed to the board he had me punch up their resumes to make the case for their appointment. In the case of Jason, I believe, he also had me punch up the resume of Mike Noe, the president of Iron Wind Metals, which I suspect Ken of co-owning as the result of that fraudulent trip to Ohio where he forced me to be one of his "seconds" in a bonding ceremony with his mistress and then had me guard his tent while he was having sex with her. Ken used Mike's resume as "another candidate for consideration" to contrast against Jason. Basically radar chaff."

From Page 99 - This one I can personally attest to: "giving away hundreds or possibly thousands of dollars in OKC samples to gaming convention attendees—Trbovich’s friends—who had nothing to do with the Trbovich Companies;" Back in 2016 (17?) someone came to the booth with a bunch of knives and said "these are for you guys!" I had no clue who was giving it to us at the time, but now I do. Go figure.

Also page 99: "funneling corporate funds into Monster Fight Club and other businesses owned and/or operated by Officers and/or “Independent” Directors on the Board, which are wholly unrelated to Servotronics or OKC;"

Finally from page 100: "approving full reimbursement for massively lavish all-expenses-paid “business trips” taken by Trbovich and others, including Gygax, Grayson, and Redd, as well as contractors and friends of Trbovich, some of whom he had an ongoing personal and/or sexual relationship, including, without limitation, Candace Miller and Noura Ibrahim."

Phew. That's a lot of mentions.

Perhaps the most disturbing revelation is that Turbo was/is still using an AOL email account. I can't wrap my head around it ;)

In any case, these are simply allegations at the moment, and Luke and Gary Con are not named defendants in the lawsuit.

Luke reached out to me on Monday and explained that Turbo stepped in when Gary Con's operations manager left after being caught taking from the till and had volunteered to help the con through 2019 and that Turbo hasn't been involved with the Con in recent years. (Edit 9/30/21): For those inquiring, Dale Leonard WAS NOT the individual in question and left Gary Con Staff the year prior. Thank you Dale for the clarification.)

Kickstarter - Necropolis: An Epic Adventure in the Desert Sands (S&W / 5e)


The legendary adventure updated and rewritten for 5e and S&W! An ancient evil has reawakened in the Necropolis...

Necropolis is an interesting IP. The original version was written by Gary Gygax, using the D20 license and the 3x OGL, and was NOT owned by the Gygax Estate upon Gary's death.

The current version being kickstarted, Necropolis: An Epic Adventure in the Desert Sands is a rewrite of the original, updated, and expanded for Swords & Wizardry and 5e.

Based on the original work by the grandmaster himself, Gary Gygax, Necropolis is an epic desert adventure series for 5e D&D and Swords & Wizardry. Previously published by Necromancer Games as a d20 system adventure, it has been entirely updated and revised by Mark Greenberg, co-author of The World of the Lost Lands by Frog God Games. Addressing Accusations Made by Gail Gygax about your Humble Bartender during her Latest Rants

Sadly, today Gail Gygax went off the rails in regards to the Will Luke Gygax recently filed in a Wisconsin Court. Apparently, Gail never filed a will when Gary passed (this was surprising) and Gail is lashing out to defend her source of income - selling Gary’s gaming collection.

In the midst of her often disjointed comments and accusations made about Luke Gygax and his siblings on Facebook yesterday, she laid the following at my feet:

As I’ve stated in the past, I joked that Gail would trademark the “C” word if she could. This was in reference to Gail trademarking “Gygax” and filing a legal action against the “new” TSR for publishing their gaming magazine under the Gygax name.

I never threatened to throw bricks at Gail during Garycon or at any other time. I am quite sure I made jokes about Gail and her infamous bricks (a bad joke about burning rubber bricks was one of them) that she has been threatening to sell for years - Paul Stromberg will apparently be selling bricks for the Gygax Memorial. I won’t be holding my breath.

I've never been invited to, attended, or paid to attend a VIP dinner or anything similar, at Gary Con or any other convention for that matter. I never gave or paid Gary Con, Luke, or any other Gygax family member or convention staff member $1,000. Hell, Luke and I have never conversed in person.

Oh, and the first sentence is total bullshit too. If a "counselor" thought someone was in danger to be killed and did not refer it to the police, they'd be risking their license. If it was referred to the police and they took no action, it was groundless.

Can I be an asshole? Most assuredly. Have I been a burr in Gail's ass regarding the Gygax Memorial Fund? Guilty. Have I done any of what she accuses me of above? None whatsoever.

Edit: I didn’t want to address this, as I believe Gail is unwell, but there are a number of people on Facebook and elsewhere that believe her accusations without question.

Questions Regarding Gail Gygax and the Gary Gygax Will

One of The Tavern regulars submitted the following questions regarding the Gary Gygax will Gail Gygax is disputing:

1) What does Paul Stormberg have to gain by alienating the Gygax family (minus Gail) by pushing through with these auctions?

2) It is known that Gary owned the original PHB painting and Paul Stormberg the original DMG painting. Where are these paintings now? If they were sold, who was the selling agent? (Rumor is that Australian Banker and TSR collector living in Hong Kong, Matthew Kodor owns both of these items. It is further rumored that he paid in access of $100k apiece for these paintings).

3) When Gary died Wisconsin required probate for all estates of $50k or more. There have been a number of Gygax auctions run by Paul Stormberg on Gail's behalf, was an access of $50k raised?

With the reported numbers on the animation auction running at over $40k it certainly looks like the physical assets of the estate alone (without valuing the IP) was well in excess of $50k.

4) Why does Paul Stormberg feel that these auctions need to be pushed through without pause? Is there a contract, memorandum, or letter of agreement binding him to complete these auctions?

5) If Gail has sold the original PHB painting and other, unique assets can it not be argued that her actions greatly diminish the overall value of the estate? Selling these items prevents the family from ever monetizing these items as well as diminishing Gary's legacy.

Case in point, the animation cells up for auction were hand-selected by Gary, in his very unique role with the D&D cartoon, as items to have and pass down via his estate. There is no finer single collection of animation cells from the cartoon. Is Gail acting in the best interest of the trust, Gary's legacy, or even herself?

6) Paul Stormberg has moved his auctions to his own bidding site, where there is no transparency. What other items might be up for sale that have not yet been discovered? Might this represent a final looting of Gary's estate?

The IP legacy of Gary Gygax has been squandered since his death. The longer the wait for the release of materials based on his IP, the more the value is diminished. Gary's fans are aging, and a majority of them now are in their late 40s and by the 20th anniversary of Gary's death, a large number of them will be in their 60s.

With the changing currents in the gaming industry, what will be left? What reason is there for not having released Gary's materials commercially, while squatting on trademarks and never using them?

Luke Gygax Statement re: Sale of Gary Gygax Estate Items at The Collector's Trove

Heads Up Collectors: Gail Gygax is auctioning items that may be part of my father’s estate through Paul Stormberg and the collectors trove- his business. There is a legal action filed to open probate and recognize the Last Will and Testament of my Dad that I was only made aware of late last year. Gail is contesting the Will because it leaves some items to my siblings, Ernest Gary Gygax Jr. Elise' Gygax-Cousino Heidi Gygax Cindy Gygax, including the rights to his legacy after Gail passes away. Currently there is nothing illegal about Gail selling the estate items in auctions but in my opinion, it is immoral. If you agree please don’t bid on them. And I let Paul know about this months ago as well.  So he is choosing to do this with full knowledge.

For full disclosure there are questions as to the ownership of the property being auctioned on behalf of Gail Gygax. Paul is aware of the questions and although not illegal it is morally questionable. There is an action in Walworth county to open probate and execute the Last Will and Testament of Ernest Gary Gygax initiates by my siblings minus Alex. It is being contested by Gail because it leaves items to us and she doesn’t want to part with anything despite what the will says.

Is Gail Gygax Illegally Retaining / Selling Rob Kuntz's Physical Property?


I received the following from a personally known individual that wishes to remain anonymous. It was received last night. It went public a few hours ago on Facebook. Highlights are mine.

This is a Public Notice to Private and Public RPG/Game Collectors, to all Game Companies, to RPG Historians, Film Industry Companies and all and Other.

That the Gygax Estate and their agents (past or present) have had repeated demands of them made by the Estate of Robert J. Kuntz to return Mr. Kuntz’s physical property held by the former. That to date the Gygax Estate refuses to comply with this request that was originated May 18, 2018.

That there is a substantiated rumor that the Gygax Estate has moved to sell all of its physical literary estate properties and that at least one major collector has been contacted regarding purchasing of same.

That the physical property of Robert J. Kuntz, a stolen property, may be part of this transaction and that Mr. Kuntz is now effectively and publicly warning those enumerated in paragraph one, above, of these circumstances.

That the matter of a prior pending civil lawsuit by Robert J. Kuntz against the Gygax Estate regarding the return of said properties is by his legal representatives:

against the Gygax Estate and all and others that may be implicated in the sale or receiving of Robert J. Kuntz’s property as enumerated below.

That Robert J. Kuntz is also pursuing through counsel additional felony theft and/or fraud charges associated with the Gygax Estate’s illegal duplication of his physical and literary IP and transfer of it by the Gygax Estate to Tom DeSanto in 2016 for the express purpose of developing it for monetary gain.

That, in due course, Tom DeSanto was made aware that this was not the Gygax Estate property (as well as other properties that were claimed by the Gygax Estate that were not theirs) which, in part, caused suit to be filed against the Gygax Estate by Tom DeSanto, in part and in case 1, for fraud (see above images). Agreements between Mr. DeSanto (as a victim of the Gygax Estate’s fraudulent activities) and Robert Kuntz have been reached and he is not involved, at all, in the pending criminal/civil/or other legal charges aforementioned and that are now being forwarded.

Note that by their uneventful return I would grant duplication of the originals for replacement purposes, this so as to not "gut" the castle and thus diminish its perceived value for presentation/developmental purposes.

Thus this request does not preclude me contributing these levels and the IP they represent to any castle project should I become contractually involved in such. I am requesting their immediate return due to:

1) An offer for their purchase as I noted with Gina.
2) The concerning particulars of their transfer to a third party without my knowledge or consent; and the subsequent threat of a pending lawsuit between the former partners who were the sender (Gail) and receiver (Tom DeSanto) of my IP. 3) My numerous requests through Paul Stormberg for Gail to communicate with me upon this matter and to discuss my possible participation in such a project as is now being pursued, which have, to date, been unfruitful.

As I am, and have always been, interested in successfully furthering any project regarding the castle or original campaign materials I believe it would be enlightening to offer a quick synopsis of various related designs I was involved in:

Several other castle levels were worked on by both Gary and I, sometimes Gary doing the map and myself designing the keys, sometimes I redrew Gary's maps, and sometimes we worked on both, together. These are not included in the above list as they are distinctly shared designs.

Within the collection will be the four-page City of Greyhawk color map. Gary created the southeast section or "Old City" while the southwest, northwest, and northeast sections were created by Gary and I together. Along with the map there are two pages of color coding keys created by myself.

Gary detailed certain areas of the city, Odd Alley & Weird Way, and I detailed other areas, such as the Church of the Latter Day Old Ones, shops and the warehouses serving as the front for Fu-Manchu (aka Fu's Front), Green Dragon Inn, etc. I alone created the sewers and catacombs beneath the city and detailed them on a four-page map. This map in turn connects to another of my designs for the campaign--a temple to the Old Ones.

As Gary became increasingly involved in the day to day affairs of TSR I began detailing more and more parts of the campaign, such as the Outdoor region of the Wild Coast and numerous other adventure locales.

This can be referenced in a lengthy essay (2013) at my blog, "The First Living Campaign": http://lakegenevaoriginalrpg.blogspot.fr/…/the-first-living… This, near its end, includes an old (1998) World of Greyhawk marketing plan that I submitted to WotC with Gary's approval and of which Gail might be familiar with.

I retain my personal notes and designs from this period and could potentially bring them to any project regarding the greater scope of the original, ground level campaign (D&D's pre-publication, 1972-1974). In particular, I have the maps, keys, and designs for several other levels for the castle--Bottle City, Demonworld, The Stalk, and many others. Gary and I had never planned (pre-TSR) to stop developing castle levels and its offshoot materials, all of which tied into the various cities, regions and outer-plane areas. This made the Castle more than a castle, of course, which was our intent, but also an annex for further and expanding adventure locales.

I am requesting your acknowledgement within 10 days of your receipt of this communication of your good faith intent of returning my IP as requested; and another two weeks following that acknowledgment of completing its return, the latter which we will then communicate upon regarding how that can be executed.

3) Additionally, there is one level that has a map drawn by a classmate of Ernie Gygax at Badger High. Rob and Gary labeled the map and created the key together but Rob is *not* asking for this:

4) Ultimately, there are a number of other examples of shared development of campaign materials between Rob and Gary. Rob is *not* asking for these but I shall mention them for your awareness:

The Four-Fold City Map & Keys (done both by Gary & Rob)

The Green Dragon Inn Map & Key (done by Rob)

5) Rob does retain a few of the original level maps and keys that he created in their entirety for the castle. These levels are well know to his and Gary's fans. If he was involved with any future project regarding the castle he would bring these levels with him:

The numbers, if totaled, come down to 41 levels contributed by Gary, 21 by Rob, and 6 levels with shared creations.

6) Finally, in addition to all of the campaign and castle information Rob has in his head he still retains his own design notes and maps for the greater campaign. The contribution of these materials would be invaluable to the success of projects regarding either the campaign or castle.

In 2016 Three Line StudioTLB Games released the El Raja Key Archive, ©1971-2016, Robert Kuntz containing 1,000 image scans of maps, keys, mss and other artifacts that he created and controls the IP thereof. As with past product releases (2002 to present) this established an absolute and unchallenged ownership by Mr. Kuntz. A great number of these scans and copies are exact duplicates of the original physical properties that the Gygax Estate holds and has repeatedly refused to return to Mr. Kuntz.

Any person having knowledge of the illegal offer to transfer, sell or duplicate Robert J. Kuntz’s properties, secretly or publicly, should be forewarned by the above-listed information. They should contact the Robert J. Burning Down the House - of Gygax (Gail is on a Facebook Meltdown / Sympathy Tour)


There has been a trickle of Facebook postings by Gail Gygax recently (my God but they have accelerated today) that are verging on libel regarding Tom DeSanto and Luke Gygax (as well as some inaccuracies with me). Nearly every post is Gail railing on the two above, accusing them of suing her in an attempt to take Gary's IP and her house. If you are on Facebook and haven't seen this mess yet, send Gail a friend request - she's been adding Facebook friends like they are going out of style the last few weeks.

I'm not going to post any her postings here - all I have is screenshots and they don't read well in a blog post, but I AM going to share a piece from Gail's Kotaku article which I fund VERY relevant:
Two years after Gygax and DeSanto struck a deal, DeSanto was suing for breach of contract. DeSanto says he spent “thousands of hours” and “substantial sums of money” trying to develop the Gygax IP. Speaking through his lawyer, DeSanto did not elaborate on what exactly he was working on outside of sorting through what Gail does and does not own of Gary’s estate, although the complaint mentions a biopic. Over email, DeSanto’s lawyer sent the following statement to Kotaku. 
“My client was left no choice but to file a lawsuit seeking to enforce the rights promised him in the Gygax IP. Tom has developed and produced some of the biggest franchises in movie history, and he is clearly in the best position of anyone to develop and exploit the very rich library of material left behind by Gary Gygax. That is very reason why Ms. Gygax entrusted it to Tom. We are more than certain in our legal position and, in the end, everyone stands to benefit from enforcement of the agreement, including and especially Gail Gygax and her family.” 
What triggered the lawsuit appears relatively benign at first, just another balloon in the parade of lawsuits that Gary’s legacy has drawn. It was a deal that Gail had made, along with her son Alex and archivist Paul Stormberg, to produce a video game based on Gary’s Castle Greyhawk, later named Zagyg, with a company called Fig, which runs a crowdfunding platform for indie games. DeSanto, who was not involved, said this was part of an effort to “freeze” him out. In a response to DeSanto’s lawsuit, Gail contested that she and DeSanto had ever entered into a partnership and, on top of that, contests that their contract gave DeSanto rights to Gary’s “entire library.” Further, she says, DeSanto made up her entire Variety quote. 
It’s unclear whether Gail meant to give DeSanto the full rights to control what happens to her late husband’s creations and name. Should DeSanto prevail in court, it would add to the heaviness of the legend story Gail carries on her shoulders—one more stone of animosity and betrayal to weigh her down, one more piece of evidence that “they” are out for Castle Greyhawk, the Gygax name, and the great Gary Gygax mythos. This is the tidy tale, the one that makes sense in the the linear storyline of victimhood.
DeSanto’s lawsuit could have even larger implications for Gail, ones that don’t fit in that linear storyline. Beneath its allegations of breach of contract and fiduciary duty, DeSanto’s suit claims that Gail does not, in fact, own the rights to Gary’s legacy as freely and clearly as she claims. 
In May 2017, DeSanto’s suit reads, he learned that Gary Gygax had a second will. He wrote it shortly before his death. That will, according to the complaint, merely gives Gail a life estate to some of Gary’s IP—the parts his children couldn’t claim. That would mean that, when Gail dies, DeSanto would no longer have the rights to develop Gygax properties, making their contract worthless. 
Gail agrees that this will exists, but denies that it is valid. She says it was not signed correctly, adding nobody had ever contacted her about the will’s validity before DeSanto.
Read those last two paragraphs again. It means that Gary changed his will - changed his mind about the long term inheritance of his legacy.  Gail knows that. She admits the will exists that would supersede the one she claims all rights via. She knows her late husband's intents towards his children - to, in the end, let them inherit his IP. Yet Gail claims a technicality in her attempt for full rights, beyond death, that wasn't Gary's intent.

I wonder if DeSanto's lawsuit has brought up feelings of guilt for Gail.

In any case, she needs help. More significant help than the community can provide. One that only family can provide. I hope she takes the help I am sure is being offered, sooner than later.
